These Terms of Service (these “Terms”) represent an agreement between you (“you” or “End-User”) and dream book LLC (“dream book”) to upload a home plan through our Site or have dream book convert one or more a plan sets for a house, garage, and/or other structures (“Plans”) into a 3D model (“3D Model”) (“Conversion Services” or “Services”) to be used in dream book’s application, which together with such websites, products or services, is referred to collectively as the “Site” in these Terms.
1. You acknowledge that you have secured sufficient licensing and authorization from owner of the intellectual property rights to the Plans to enter into this agreement. You agree to indemnify dream book and its affiliates from any claims arising from your failure to secure the necessary intellectual property rights.
2. You agree to abide by the dream book 3D Terms of Use located at https://dreambook3d.com/terms-of-use/.
3. The 3D Models delivered as part of these Terms is intended to be an artistic representation, and not an exact copy, of the Plans provided or of any structure that is built based upon the Plans. Modifications to plans and/or models performed by dream book are solely for use within the Site and may not be used elsewhere in whole or in part without the express written consent of dream book.
4. The 3D Models are intended to be interacted with similarly to other 3D models that are available on the Site. You will receive a URL by which to access your 3D Model within the Site. If You have multiple 3D Models on the Site, dream book may offer the option, at additional cost, for a link or links for users to view, and/or search for, a catalog of your 3D models within the Site. dream book retains the right to add, modify, and/or remove functionality at any time.
5. Pricing for Conversion Services will be determined based upon a review of the Plans you provide to dream book. You will receive an invoice for the agreed-upon amount and your initial payment of the invoice will constitute your acceptance of Terms and agreement to pay the total amount of the Conversion Services. dream book reserves the right to withhold 3D Models from the site if the Conversion Services are not paid in full. You are responsible for any applicable taxes.
6. Changes to the Plans, custom materials, furniture, cabinetry, and other detailed elements may be available at additional cost and will be priced under separate agreement, subject to availability.
7. For plans that you upload yourself, you are solely responsible for the content and behavior within the system based upon adherence to dream book’s requirements and the type of license purchased. dream book reserves the right to suspend your ability to upload updates to your models if fraud or abuse is suspected.
8. Cancellation and refund policy. Payments received are not refundable, and these Terms are not cancellable after receipt of the initial payment. dream book reserves the right to issue refunds on a case-by-case basis in our sole and absolute discretion.
9. Miscellaneous
a. No partnership or employment relationship is created by these Terms.
b. The person accepting these Terms warrants their authority to bind their party.
c. These Terms are governed by U.S. laws, with any disputes resolved in Ohio.
